The challenge

A newly completed development of four residential dwellings required the installation of solar panels in order to satisfy Building Control requirements and achieve sign-off.

However, the site was located within a conservation area, and the project architect had advised that the installation of solar panels could not be carried out under permitted development, necessitating a full planning application.

This created a risk of delay to completion, with uncertainty over whether permission would be granted and the potential for the units to remain unsigned-off.

Our strategy

The project manager approached us for a second opinion. Following a detailed review of the relevant legislation and permitted development rights, we identified that the solar panels could in fact be installed under permitted development, provided they were designed and positioned in accordance with the applicable criteria.

We advised on the correct technical approach, ensuring compliance with all relevant limitations and conditions.

An application was then prepared and submitted. During the process, the planning officer raised technical objections, questioning whether the proposal complied with permitted development requirements within a conservation area.

We responded with clear references to the legislation, demonstrating that the proposal met all relevant criteria and overcoming the officer’s concerns.

The outcome

Planning permission was successfully secured, enabling the installation of solar panels and allowing the development to achieve building control sign-off without delay.

The project avoided unnecessary redesign, delay and risk, ensuring the timely completion and occupation of all four dwellings.
